These Terms of Service ("Terms") govern your access to and use of Caliper ("Caliper," "we," "us," or "our"), including our website, waitlist, and any software, skills, or services we make available (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Caliper is currently in an early-access / alpha stage. Features, availability, and pricing described on this site are subject to change without notice, and some features may not yet be available. The Service is provided on an "as is" and "as available" basis.

2. Waitlist & Accounts

When you join our waitlist or create an account, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under it.

3. Acceptable Use

You agree not to misuse the Service, including by: attempting to gain unauthorized access to our systems or another user's data; interfering with or disrupting the integrity or performance of the Service; or using the Service to violate any applicable law or the rights of a third party.

4. Third-Party Services & Models

Caliper routes, measures, or otherwise interacts with third-party AI models, harnesses, and hosting providers. We are not responsible for the availability, accuracy, or output of any third-party model or service, and your use of those third-party services may be subject to their own terms.

5. Intellectual Property

Caliper's core routing and cost engine is made available under an open source license as described on our website and repository. Except as expressly granted under that license, all other trademarks, logos, and content on this site remain the property of Caliper or its licensors.

6. Disclaimer of Warranties

To the fullest extent permitted by law, Caliper disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, Caliper and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

8. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
